1. Agreement

These Terms govern your use of Roost, operated by Roost (operated by Sudarshan Uprety, Kathmandu, Nepal). By creating an account or using any part of the service, you accept these Terms. If you are accepting on behalf of a company, you confirm you have authority to bind that company.

2. What Roost is — and is not

Roost provides software for home watch, property care, and similar businesses to manage checklists, reports, schedules, client communication, and billing.

Roost is not a home watch, inspection, property management, or security company. We do not visit homes, inspect properties, hire vendors, or take responsibility for any property. Operators are independent businesses solely responsible for the services they provide to their clients.

3. Accounts

  • You must provide accurate information and keep your credentials secure.
  • You are responsible for activity under your account and for managing your staff accounts and their access levels.
  • You must be at least 18 to create an account.

4. Client and vendor access (magic links)

Client and vendor access to reports, approvals, and invoices uses single-use, expiring magic links. Once opened on a device, that device stays signed in until you revoke access or the session expires. You are responsible for revoking access when a client relationship ends or a device is lost. We provide a one-click revoke for every client and family member.

5. Your responsibilities as an operator

  • Legal authority: you warrant that you have the legal right to access and inspect every property you record in Roost (owner authorization, key-holder agreement, or equivalent).
  • Client consent: you are responsible for having the necessary consent from your clients to enter their personal and property data (including access codes) into Roost, and for providing them any legally required notices.
  • Insurance: you are solely responsible for maintaining your own business insurance (general liability, bonding, E&O as applicable). Roost documents do not replace your professional judgments or your coverage.
  • Licensing: you are responsible for any licenses or accreditations your jurisdiction and industry require.

6. Acceptable use

  • Use Roost to enter a property without legal authorization
  • Store or process data you have no right to put in the system
  • Attempt to access another operator's data, reverse-engineer the service, or circumvent security controls
  • Resell or provide the service to third parties as if it were your own product
  • Use the service in violation of applicable law

We may suspend accounts for serious violations or where required to protect the service or other users' data. We will give notice where practical.

7. Subscriptions, trials, and billing

  • Plans and prices are shown on the pricing page. Subscriptions are monthly unless you choose annual.
  • Paused homes never count toward plan limits. Seasonal pauses are free by design.
  • Trials: free trials (if offered) require no credit card and convert only if you choose a plan.
  • Founding members: founding pricing, where offered, is locked for the life of the subscription while the subscription remains continuous.
  • Payment is processed by our payment processor. Failed payments cause the account to enter a read-only grace period (3 retries, then read-only); your data is never deleted for non-payment without 30 days' notice and an export offer.
  • Price increases for existing subscribers are announced at least 30 days in advance and apply at the next renewal.

8. Cancellation and refunds

  • You can cancel any time from your account settings; access continues to the end of the paid period. No cancellation fee.
  • On cancellation you can export all your data (one-click export) for 30 days after the subscription ends.
  • Refunds are issued at our discretion for billing errors or proven, unresolvable service failure within the billing period.

9. AI-assisted features

AI features assist operators — they never publish anything without operator review. AI output may be inaccurate. You remain solely responsible for the content of any report, approval request, or invoice that you send, including any AI-assisted text you choose to keep.

10. Intellectual property

We own the Roost software, including improvements. You own your data: your checklists, reports, photos, client lists, and records. You grant us only the limited right to host and process that data to provide the service.

11. Service availability and modifications

We aim for reliability but do not guarantee uninterrupted service. We may add, change, or remove features; material reductions to a paid plan will come with notice and, where reasonable, a price adjustment option.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ROOST DOES NOT WARRANT THAT REPORTS OR AI OUTPUTS ARE ERROR-FREE OR SUITABLE FOR ANY INSURANCE, LEGAL, OR REGULATORY PURPOSE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOST'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PROPERTY DAMAGE, INJURY, LOSS OF PROFITS, OR LOST DATA ARISING FROM THE PERFORMANCE OR NON-PERFORMANCE OF HOME WATCH, INSPECTION, PROPERTY CARE, VENDOR, OR OTHER SERVICES THAT YOU OR YOUR VENDORS PERFORM.

Read this clearly: Roost stores and organizes your documentation. It does not watch, inspect, secure, or guarantee any property. If a property is damaged, the responsible party is the person or company that performed (or failed to perform) the physical service — not Roost.

14. Indemnity

You agree to indemnify and hold Roost harmless from claims by third parties (including your clients and vendors) arising from your use of the service, your entry of data into it, or the physical services you or your vendors perform.

15. Termination

You may stop using the service at any time (see section 8). We may terminate accounts for non-payment (after the notice and export window described in section 7) or for serious violations of section 6. On termination you retain the right to export your data for 30 days.

16. Governing law and disputes

These Terms are governed by the laws of Nepal. Disputes will first be addressed by good-faith negotiation via hello@theroost.watch. If unresolved, disputes will be settled by binding arbitration under the rules of a mutually agreed arbitration institution, seated in Kathmandu, Nepal.

17. Changes to these Terms

We may update these Terms as the service evolves. Material changes will be announced to active operators by email at least 14 days before they take effect. Continued use after the effective date means acceptance.
